Edify’s Standard Licence Terms.

This page contains some general information about common intellectual property issues that arise in the creative industries that we work in. We’ve made this page primarily to help make sure we’re on the same page with the legal stuff, which is so often glossed over!

Our terms are only binding if you agree to them and they can also be altered by any written agreement between you and Edify. This can be simply by us agreeing to another arrangement by email.

General Information.

Copyright.

In Australia, a photograph or video is automatically protected by copyright as soon as it is taken. In almost all cases, whoever created the photo or video will have copyright in the works.

The copyright owner has the exlusive right to reproduce, publish or license the images or video.

More often than not, commerical clients purchase a license to use the photos and copyright stays with the creator of the works.

You may ask to also purchase the copyright to images and video that Edify creates, however be aware that this usually attracts a much higher fee.

Moral Rights.

The creator of an image or video automatically has certain “moral rights“ separate from copyright. These include the right to:

  • be attributed as the creator of the work

  • take action if the work is falsely attributed

  • take action if the work is distorted in a derogatory way

Moral rights cannot be purchased or licensed under Australian law - sorry!

Edify may agree to waive its moral rights in some circumstances, but you will need to get our consent in writing.

Otherwise please credit us wherever you republish our works - tagging our business pages on social media or linking to our website is perfect.

Occasionally it might be too distracting (or obnoxious) to credit us in an obvious way. We get it and we don’t want to detract from your own marketing or business activities. If you let us know in advance that you don’t wish to credit us, we can waive our right to be attributed and it will avoid an awkward conversation later!

Licencing.

Rather than purchasing copyright, it is more common for clients to purchase “usage rights” by way of a license.

Your license determines how you can use the images and video you commission from Edify.

Edify’s standard terms includes a worldwide, permanent, royalty-free license for promoting your business, organisation, project or event, and limited rights to pass on images to others involved in the project or event.

Our standard terms do not include things like on-selling our imagery or merchandising.

If you want to do these things, you have to ask first and we may charge an additional fee or a royalty.

We are always happy to negotiate a different licencing arrangement if our standard terms are inadequate for your purposes.
